Introduction:

These Terms of Service and Mobile Terms and Conditions (“Terms”) govern your access to and use of Right Impact’s websites (rightimpact.org, app.rightimpact.org) and mobile application (“Right Impact,” “we,” “our,” or “us”). These Terms apply to all users of the Right Impact platform and related services, including any messaging, communications, data, or mobile functionality.

By accessing or using any part of the Right Impact platform—including but not limited to texting, calling, polling, voicemail pushes, voter data, LinkUp features, or other outreach—you agree to be bound by these Terms and all applicable federal, state, and local laws. If you do not agree, you may not use the Services.

Message and data rates may apply. By opting in to this service, you consent to receive mobile text alerts sent through an automatic telephone dialing system. Consent to receive text messages is not a condition of purchase. By signing up, you confirm that you are over the age of 13.

Scope of Services:

Right Impact provides technology services to authorized political organizations, campaigns, and clients to facilitate lawful communication and outreach. These services may include:

  • Text messaging, polling, calling, and voicemail outreach

  • Data analytics, voter data integration, and campaign tools

  • The LinkUp relational organizing tool (see Section 6 below)

  • Client dashboards, web applications, and mobile interfaces

Access to the platform is provided at Right Impact’s discretion and may be suspended or terminated for any misuse, illegal activity, or violation of these Terms.

OPT-IN:
To receive messages, updates, and alerts from Right Impact, text INFO to (208) 314-2212. Messaging frequency varies. Message and data rates may apply.

STOP:
To stop receiving messages, text STOP to (208) 314-2212. You will receive one final confirmation text confirming your opt-out.

User Responsibilities and Legal Compliance
By accessing or using Right Impact—including the websites rightimpact.org and app.rightimpact.org and the Right Impact mobile application—you acknowledge and agree that all communications, messages, or outreach conducted through the platform are initiated at your sole discretion and under your exclusive control. You represent and warrant that you or your organization have been verified and approved as a political organization through Campaign Verify, that you are using an approved 10DLC number, and that you are sending communications only to recipients who have explicitly opted in to receive such messages.

You further affirm that all communications sent through the Right Impact platform comply with all applicable federal, state, and local laws and regulations, including but not limited to the Telephone Consumer Protection Act (TCPA) (https://www.fcc.gov/general/telemarketing-and-robocalls) and the Federal Communications Commission’s rules on political campaign calls and texts (https://www.fcc.gov/rules-political-campaign-calls-and-texts), as well as any related state campaign and data-privacy laws.

All messages sent through Right Impact must include appropriate disclosure and opt-out language, such as “Paid for by [Organization Name]” and “Text STOP to end.”

Only pre-approved organizations and campaigns authorized for use on Right Impact platforms may send messages.

Right Impact is a technology platform only and does not originate, control, monitor, or approve the content of any user messages. You are solely responsible for obtaining all required consents from recipients prior to initiating communications and for ensuring that all content, audience selection, and delivery methods comply with applicable laws and ethical standards.

Release of Liability and Idemnification:

You accept full and sole responsibility for the content, audience selection, and delivery of all messages, calls, or outreach conducted through the platform.

You agree that Right Impact shall bear no responsibility or liability for any claims, penalties, fines, or damages arising from your use of the platform or from any message transmitted, including but not limited to alleged violations of the TCPA, FCC regulations, or state telecommunication laws.

By using Right Impact and its services, you agree to indemnify, defend, and hold harmless Right Impact, its parent company, affiliates, officers, employees, and agents from any and all claims, damages, liabilities, or legal actions arising out of or related to your use of the platform, including content sent or uploaded through it.

LinkUp Feature:
The LinkUp feature allows users to voluntarily upload their personal phone contacts to the Right Impact system via the mobile app. The feature is designed to identify which of a user’s contacts are registered to vote and to facilitate personal, one-to-one text messages to those contacts for civic engagement.

  • Uploading contacts is entirely voluntary and requires the user’s explicit consent.

  • Uploaded contact data is visible only to the user and is not shared, sold, or used for any marketing purposes.

  • Users may delete their uploaded contact data at any time through the mobile app or by submitting a request to info@rightimpact.org.

  • Right Impact may retain minimal metadata (such as record of deletion) as required by law or for security and auditing purposes.

By using the LinkUp feature, you represent that you have consent to upload and message those contacts and agree to comply with all relevant consent and privacy laws.

Data Use & Privacy:
We take your privacy seriously. Information you provide is collected solely to facilitate communications you have authorized or requested. We do not sell or share user data for marketing purposes.

License and Restrictions:
Right Impact grants you a limited, non-exclusive, non-transferable, revocable license to use the platform and services for lawful purposes consistent with these Terms.

You may not:

  • Reverse engineer, modify, or copy the software or source code;

  • Use the Services for any unlawful or fraudulent activity;

  • Transmit spam, unauthorized communications, or content that violates any law;

  • Access or use another user’s account without authorization;

  • Upload, distribute, or store harmful or malicious code.

Right Impact reserves the right to suspend or terminate access if these conditions are violated.

Third Party Integrations:
Right Impact may integrate with third-party services and providers to deliver certain features and functionality within the platform, including but not limited to messaging carriers, data vendors, payment processors (such as Stripe), and cloud-hosting or analytics partners (such as AWS or Twilio). These integrations are provided to enhance performance, communication delivery, data management, and user experience. By using the Right Impact platform, you acknowledge that some of your information and activity may be transmitted through or stored by these third parties as necessary to perform authorized services.

Right Impact does not control and is not responsible for the content, privacy practices, or security standards of any third-party integrations. Your use of those services may be subject to the separate terms and privacy policies of each respective provider. We encourage users to review all applicable third-party terms before enabling or using integrated features.

Right Impact limits all data sharing with third-party vendors to only what is required to provide the Services and maintains reasonable safeguards to ensure such vendors protect user information in accordance with applicable law and our Privacy Policy.

Termination:
Right Impact reserves the right to suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or any applicable law, or if continued access poses a security or compliance risk.

Limitation of Liability:
To the fullest extent permitted by law, Right Impact and its affiliates shall not be liable for any indirect, incidental, consequential, punitive, or exemplary damages arising from your use or inability to use the Services, including but not limited to lost profits, data loss, or unauthorized access to your information.

Governing Law and Dispute Resolution:
These Terms shall be governed by and construed in accordance with the laws of the State of Idaho, without regard to conflict-of-law principles. Any disputes arising out of or related to these Terms or your use of the Right Impact platform shall be resolved exclusively through binding arbitration in Ada County, Idaho.

Changes to These Terms:
We may modify or update these Terms at any time. Updates will be effective immediately upon posting. Continued use of the service after such posting constitutes your acceptance of the modified Terms.
